Terms & Conditions

Last updated: 28 October 2026

1. About these Terms

These Terms and Conditions govern your use of the OnTheLadder website at https://www.ontheladder.net and our consumer-facing mortgage introduction service.

“OnTheLadder”, “OTL”, “we”, “us” and “our” refer to Ben Smith, a sole trader operating under the OnTheLadder trading name.

Contact: hello@ontheladder.net

By using our website or submitting a mortgage enquiry, you agree to these Terms to the extent that they apply to your use of our service.

Please read these Terms alongside our Privacy Policy, which explains how we collect, use and share personal information.

2. Our service

OnTheLadder is a mortgage lead-generation and introduction platform.

We provide a service that allows people seeking mortgage-related assistance to submit an enquiry and be introduced to a mortgage adviser.

Our service may cover enquiries relating to:

  • First-time buyer mortgages.

  • Moving home.

  • Remortgaging.

  • Buy-to-let mortgages.

  • Equity release.

  • Other mortgage-related enquiries supported by our platform.

The services available may change over time.

Our service is free for consumers. We may receive payment or another commercial benefit from the mortgage adviser who receives your enquiry.

3. Our role and limitations

OnTheLadder is an introduction platform, not a mortgage adviser.

We do not provide mortgage advice, recommend mortgage products, assess the suitability of a particular mortgage for you or make lending decisions.

We do not act as your mortgage adviser, lender or mortgage provider.

Any mortgage advice, product recommendation, affordability assessment or mortgage application assistance is provided by the adviser or other professional you engage with, subject to their own terms and responsibilities.

You should independently consider whether an adviser is suitable for your needs and check their regulatory status where relevant.

We do not guarantee that an adviser will accept your enquiry, contact you within a particular period, arrange a mortgage or obtain a particular outcome.

4. Submitting an enquiry

When you submit an enquiry, you agree to provide information that is accurate and complete to the best of your knowledge.

You should not knowingly submit false information, impersonate another person or submit an enquiry using someone else’s personal information without appropriate authority.

We may contact you to verify your enquiry, clarify the information you have provided or confirm that you wish to be introduced to an adviser.

Submitting an enquiry does not oblige you to apply for a mortgage, accept advice or proceed with the adviser.

5. Introductions and exclusivity

Our standard service is based on exclusive introductions.

We intend to allocate each enquiry to one mortgage adviser rather than distribute the same enquiry to multiple advisers.

We use the information you provide, together with relevant operational factors such as the type of enquiry and adviser availability, to identify an appropriate recipient.

An introduction does not mean that the adviser has agreed to provide a service or that you are guaranteed to receive a response.

If we cannot complete an introduction as intended, we will handle your enquiry in accordance with our Privacy Policy and applicable law. We will not automatically distribute your information to multiple advisers.

6. Mortgage advisers and third parties

Mortgage advisers introduced through OnTheLadder operate independently of OTL.

They are responsible for their own services, advice, communications, regulatory obligations and contractual arrangements with you.

We do not control the advice an adviser provides, the mortgage products they may discuss, the lenders they work with or the outcome of your enquiry.

Any agreement you enter into with an adviser is between you and that adviser.

You should review the adviser’s terms, privacy information, fees and regulatory status before deciding whether to proceed.

7. Information and website content

We aim to keep our website information accurate and up to date. However, information may occasionally be incomplete, outdated or affected by technical errors.

Website content is provided to explain our introduction service and does not constitute mortgage advice or a personal recommendation.

You should not rely on general website content as a substitute for advice from an appropriately qualified and authorised professional.

We may update, modify or remove website content where reasonably necessary.

8. Our fees and commercial relationships

Consumers do not pay to submit an enquiry through our standard introduction service.

We may receive payment or another commercial benefit from the adviser who receives your enquiry.

We do not guarantee that an introduction will lead to a mortgage offer or any other financial outcome.

Where applicable law requires disclosure of a commercial relationship, commission or other benefit before an introduction, we will provide the relevant information.

9. Communications

We may contact you to verify your enquiry, clarify submitted information or administer the introduction you requested.

Submitting an enquiry does not automatically subscribe you to unrelated marketing communications from OnTheLadder.

We will handle your contact details in accordance with our Privacy Policy and applicable data protection and electronic communications laws.

If an adviser receives your enquiry, they may contact you about that enquiry. Their subsequent communications are subject to their own legal obligations and privacy information.

10. Privacy and personal information

We process personal information in accordance with our Privacy Policy and applicable data protection law.

By submitting an enquiry, you acknowledge that your information will be used to administer your request and, where an introduction is made, shared with the relevant mortgage adviser as explained in our Privacy Policy and the information provided during the enquiry process.

Please review our Privacy Policy before submitting your information.

13. Third-party websites and services

Our website may link to external websites or services, including mortgage advisers and other third parties.

We do not control those external websites and are not responsible for their content, availability, privacy practices or services.

Your use of third-party websites and services may be subject to their own terms and policies.

14. Liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

To the extent permitted by law, we are not responsible for decisions made independently by mortgage advisers or lenders, the advice they provide, their fees, the availability of mortgage products or the outcome of a mortgage application.

We do not guarantee that the website will always be available, uninterrupted or free from errors.

Nothing in these Terms removes any legal rights you may have against us or any responsibility we have for our own acts or omissions.

15. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to our service, business operations or legal obligations.

The latest version will be published on our website with its updated date.

Changes will not remove rights that have already accrued or override legal requirements. Where a change materially affects an existing contractual arrangement, we will take any notification or agreement steps required by law.

16. Suspension or termination

We may restrict access to our website or decline to process an enquiry where reasonably necessary to address suspected fraud, misuse, security concerns or unlawful activity.

We will act proportionately and in accordance with applicable law.

You may stop using our website or withdraw your enquiry at any time. Withdrawal may not require the deletion of information that we are legally entitled or required to retain.

17. Governing law

These Terms are governed by the law of England and Wales, subject to any mandatory consumer protection rules that apply to you.

Nothing in these Terms removes any mandatory legal rights or protections available to consumers.
